Good Customer Service Is the Best Sales Technique | Callagy Law

The purpose of this post is to help assist healthcare providers and owners with questions they have concerning their business or relevant knowledge in the field. The Callagy Law team is knowledgeable in many law practice areas and will frequently post topics ranging from Medical Revenue Recovery, PIP, Workers Compensation, and Commercial Insurance. We hope to have this blog shed a light on many common questions.

As a client liaison for a law firm (Callagy Law) that serves medical providers, I understand the importance of good customer service.  Our clientele expects us to help them in their recovery efforts against PIP/No-Fault insurance carriers, Workers Compensation carriers, and Commercial Insurance carriers.  Across the whole gamut of medical provider recovery against insurers, our Firm is expected to assist in the identification, assembly and pursuit of claims against carriers.

One of the functions of a client liaison in our industry–or any other for that matter–is to bridge the gap between sales/marketing and customer service.  We perform all three functions at various times in our work week.  The key to being successful in this environment is to realize all three are integral to each other.  In other words, the best way to get customers to return to you after you have won them over initially is to serve them well.  Maintaining a reliable client base is critical to success.  Moreover, it can serve as your best advertising, as when one person speaks to five others and they in turn speak to others, and on and on.  In the same way that bad reviews can kill any further inquiry from a potential customer, good reviews will do all the selling for you.  Any firm needs not only to keep customers happy, but to keep them so happy, they are anxious to sing your praises, whether asked to do so or not.

So what does good customer service actually do for us?  Let’s consider a current customer whose being contacted by a new potential client.  The new potential client will have a few questions to ask an existing customer.  Some of these are:

Are they receiving good value for the services they are receiving?

Were there any unpleasant surprises in doing business with the Firm?

Good customer service helps answer all these questions.   If we gave our customers more than they gave us, and we made sure we did so, then we did provide good value.  You always want to provide customers with more than they are paying for—that is what brings them value and what keeps them coming back.  You never want to provide less value than it is costing a client.

Good customer service also will help avoid any unpleasant surprises.  You must manage client’s expectations.  A good service representative will understand the processes of their customer and anticipate any problems.  This will lead to an effective and efficient relationship, as well as an easy going and comfortable one.

Good customer service is an effective marketing and sales tool and it does not cost anything.  The advertising it brings is free—your customer base becomes your spokesperson.  You make them happy, beyond anything they ever thought possible, and they become your champion to others who are looking for similar services.

Learning from others and seeking to find information is the first step to success. Whether you need questions answered about Medical Revenue Recovery, PIP, Workers Compensation, and Commercial Insurance., Callagy Law is here to assist you every step of the way. We are headquartered in Paramus, NJ and we are full service law firm that specializes in serving businesses, healthcare providers and individuals. Sean Callagy has assembled a team of attorneys that are exceptional leaders in their legal expertise and have been commended for providing exceptional legal services at every level. Why Not #11- Why Not Be Thankful For This, November 5, 2015 | Sean Callagy

Why Not Be Thankful For This?

Dear Kindred Spirits,

I had an amazing experience last night. As I"ve mentioned, I am currently not able to drive due to my hereditary eye disease. I remain confident that they will invent a cure, but I am temporarily unable to drive, as I see it (others, including medical science, would say my driving days are over and that my eyes will continue to deteriorated until I am completely blind -- I say no way to this).

As a result of my driving issues, I am blessed to have some folks that help me to drive. Last night, at the end of awesome night where my daughter and I visited my mom and grandmother, the gentlemen driving me was very kind to say he"s begun watching the "Why Not Huddles".

He also begun talking to me about life and some of the challenges we all face. At the end of our awesome conversation, he told me that my confidence was amazing and virtually guaranteed my success.

I explained to him that I was very flattered by his trust in sharing some of his dreams with me as well as his very kind, supportive and genrous words. I also told him he was right, that I do have tremendous confidence. However, I shared that maybe for a different reason than he thought.

"You see", I explained to my friend, "I have tremendous confidence in the human capacity. I do believe in myself at a very high level because I"m human, and therefore, share in that tremendous capacity I believe in".

We had a great ending to our chat and wished each other well until our next meeting. I left the car, after sitting outside my house chatting with him for nearly an hour, feeling so blessed to believe in people and to share that with others.

So, that"s what it"s all about: our capacity. Therein lies the secret to true confidence. Your capacity, all of our capacity, is so far beyond anything we will ever achieve. When people tell me hw amazingly successful I am, I am always touched. Then, while being proud of what I"ve done, I smile to myself knowing I haven"t touched a fraction of a fraction of my potential, and neither have they.

Today, I challenge you to really think about this, the idea of human capacity. Why Not you? I don"t mean to suggest you should belittle others or put them down. I mean, you should accept your greatness and work relentlessly consistently towards your dreams knowing that your success is assured the minute you begin.

Your success may not end up precisely the way you dream. Mine certainly didn"t when I dreamt of playing professional baseball. Yet, you will succeed wildly. I wouldn"t trade my life"s journey for anything. Neither should you.

Someday we will all sit in that rocking chair. I hope and pray we will all close our eyes knowing we seized this life and touched the lives of others in a profound way.

We all share a complete and perfect capacity for that.

Have a Why Not day, week, month, year, decade and life!!

In your service,
Sean Callagy

Don’t Let Your Claims Expire: Statute of Limitations on Workers Compensation Medical Provider Claims

The following article was written by Callagy Law’s Legal Team, and will focus on many common questions and concerns surrounding new developments, legal matters, and other procedures within the field of healthcare law Medical Revenue Recovery, PIP, Workers Compensation, and Commercial Insurance. Our mission is to answer any questions and give knowledge to many different aspects of these matters.

In 2012, N.J.S.A. 34:15-15 was amended to give the Workers Compensation Court exclusive jurisdiction over medical provider claims. Prior to 2012, it was clear that the statute of limitations for a medical provider’s claim was the six-year statute set forth in N.J.S.A. 2A:14-1, which applies to all actions of a contractual nature, express or implied, and all actions to recover on an account. Although it is unclear whether a two-year statute of limitation applies to medical provider claims filed after 2012, medical provider claims arising from events prior to the establishment of exclusive jurisdiction should carry a six-year period. The Appellate Division clearly held that the six-year period applied to the medical provider’s claim in Medical Diagnostic Assocs. v. Hawryluk, 317 N.J. Super. 338, 349 (App. Div. 1998), certif. denied, 160 N.J. 89 (1999), stating:

Finally, we deem it appropriate to discuss the statute of limitations issue in the event the Division determines that the employee’s claim is    not compensable. Plaintiff asserts that if medical providers are not allowed to bring suit in the Law Division, there is the potential that their claims will be barred by the statute of limitations. The statute of limitations is six years. See N.J.S.A. 2A:14-1. We note that there is  no statutory provision tolling the statute of limitations on the medical      provider’s claim while an employee’s claim is pending in the Division. We are satisfied, however, that if a medical provider’s suit is        transferred to the Division, as we hold today, the complaint will have been timely filed. In future cases in which the medical provider proceeds directly in the Division the statute of limitations will be tolled during the period that the matter is pending in the Division. Ibid. (emphasis added)

In Hawryluk, the Appellate Division transferred the medical provider’s claim to the Division and held that the statute of limitations for the claim was six years.  In Univ. of Mass. Mem’l Med. Ctr. v. Christodoulou, 180 N.J. 334, 345 (2004), the Supreme Court overruled Hawryluk on the necessity of transferring the medical provider’s claim to the Division for a judgment of non-compensability before a Superior Court action could be filed, but did not alter its holding with respect to the statute of limitations. Although the Legislature subsequently amended N.J.S.A 34:15-15 to give exclusive jurisdiction to the Division for medical provider claims, eliminating the Superior Court option, there is no reason to suggest that the Legislature also intended to change the statute of limitations. The statute remains six years, as it does in all collection cases of a contractual or quasi-contractual nature.

A two-year statute would unfairly prejudice medical providers who rendered services to injured employees and were entitled to rely on the six-year statute in managing collection activity on their unpaid accounts.  It would deprive medical providers of their property interests without any basis in a duly enacted statute.   It would also unjustly enrich insurance carriers who collected premiums to pay for patients’ medical bills, then deliberately underpay for services rendered to those patients.

Why Not Learn The Difference Between Action And one Action | #10 | Why Not Huddle with Sean Callagy

Dear Kindred Spirits:

Happy Wednesday Folks!!!

I am fired up today and want to give a shout out to my mom, Maureen. My mom had double knee replacement in late August of this year, which was a little over two months ago. Yesterday, my mom hit the critical goal of 120 degrees for her knees range of motion!!!!!!!! Awesome job Mom!!!!!!!! I love you and am so proud of and happy for, you.

Not long ago, they physical therapy folks were telling my mom that she was behind schedule, and if she didn’t get to where she needed to be, she would have to face this brutal surgery all over again. Instead of shrinking back, my Mom took on the pain, kicked into gear, worked out at home relentlessly consistently and now walks without a cane and has met the goal for her rehab.  Also, big props to her significant other Jerry. Jerry has been there all the way helping and supporting this process. As Willy Wonka says (Gene Wilder not the genuinely creepy and wacky Johnny Depp version),  says you’re a good egg!

Now Grammi, as my mom is known by her grandchildren, it’s time to get you back scuba diving and on skis (note: my mom has dove once and been on skis once, crashing into a house on the mountain in Vail last time she went). Let’s all start posting on Facebook challenging Grammi to hit the bubbles and the slopes!!!!!!!

For the record, my mom has been an indispensable teacher, guide and support throughout my life. No matter what, she’s always been there to gently guide me back to the path of my greatest me. While she may not have read all these books on personal development, she lives Why Not principals and always has an awesome core desire to continue to improve. She’s been conducting Bible study in a jail in New York for over a decade, she works with my law firm and has been an indispensable part of my business world for 16 years, and she even went zip lining 3 years ago at Whistler on the West Coast of Canada at night, in the pitch black walking through feet of snow in the woods, trekking 100 feet plus over the abyss. Yes, I admit on the last one I left out a few details before we all piled into the van to head off into the forest at night!

With all that said, let’s talk about the critical difference in our results formula between no action, action and zone action. Remember, there is a 3 part formula for producing or not producing any result you ever desire in your life. The entire formula is based on the concept of always knowing or figuring out quickly, how to remain in massive, consistent, relentless, zone action.

I’ve had the privilege of coaching hundreds of people whether it be for one session or a regular ongoing coaching relationship. The vast majority of people I coach, in fact, almost all of them, are so easy to help.

Yesterday, we launched our Why Not Talks with Mike Just, the owner of Just Hits. Mike has goals he’s not achieving, although he already is a rare success: a person who started a business and is successfully operating more than 5 years after starting it.

Mike said he wanted a team of 6 fully dedicated baseball trainers and better pipelines referring clients.

As almost always happens, when we discussed it on our Why Not Talk, Mike wasn’t really doing anything to achieve these goals. By the way, that always happens for folks in life and business. You’re working hard, you form habitual patters for your day and life and you think you’re working on your goals. You also begin to feel like they’re not achievable as you mistake thinking or stressing about something for “action.”

Therein lies the obvious difference between action and NO action.

However, there is a more critical distinction. I believe the greatest difference for success doesn’t lie in the difference between no action and action, but rather between action and zone action.

Why? It is simply because when people take action, as opposed to zone action, and don’t get the results they want, then they begin to really believe there goals are not reachable. They lie to themselves and say, “I tried. It doesn’t work.”

Mike was doing just, yes a pun-figure it out, that.  Mr. Just, get it?!, told me he did follow my suggestion and begin to speak in schools, BUT, he couldn’t expect the young students to bring information home to their families. I said, to quote Mr. Wonka again, “Wrong Sir!! Wrong!!!!!”

Mike was in action, but missing the “secret of small distinctions”, and, therefore, he wasn’t in Zone Action”. Accordingly, he didn’t get the results he wanted.

So, what would Zone Action have been?? Watch today’s Why Not Huddle, and I will share it!!!!!!!!!!!!!

Please spread the word. Share these articles and the Why Not Huddles and Why Not Talks with other folks on Facebook, LinkedIn and subscribe on YouTube!!!!!!!!!!! Please post your comments, thoughts and questions as well!!!! Have an amazing day. It’s YOUR life, love it and say Why Not!!! In your service,  Sean Callagy
